Domestic Abuse against undocumented immigrants.

All too often we see people coming to our law office looking for help against a family member comitting domestic abuse. Many don't seek any help in fear of getting in trouble with USCIS because they may be an undocumented immigrant. Many women in this position have children and are afraid they will be deported if they report their abusive partner or spouse. There is help for this kind of heinous abuse, it is caled the Violence Against Women Act  (VAWA). Under this protection anyone that has been abused or battered by, or has been involved in extreme cruelty by an American citizen or lawful permanent resident spouse, can self-petition for permanent residence. To receive permanent residence under this act, you must provide evidence of the abuse. One type of proof is a "court order protection of abuse", but this is not always needed. Some other forms of evidence are: reports and affidavits from law enforcement officers, doctors, school officials, clergy and social workers. The abuse can be either physical or mental.

Con demasiada frecuencia, vemos gente que viene a nuestra oficina en busca de ayuda contra un miembro de la familia cometen el abuso doméstico. Muchos no buscan ayuda alguna por temor a meterse en problemas con el USCIS ya que pueden ser un inmigrante indocumentado. Muchas mujeres en esta posición tienen hijos y temen ser deportados si denuncian a su pareja o cónyuge abusivo. Hay ayuda para este tipo de abusos atroces, es caled la Violencia contra la Mujer (VAWA). Bajo esta protección que nadie ha sido maltratado o maltratadas por, o ha participado en la crueldad extrema por un ciudadano estadounidense o el cónyuge de residente permanente legal, puede auto-petición para la residencia permanente. Para recibir la residencia permanente bajo esta ley, debe presentar pruebas de los abusos. Un tipo de prueba es una protección judicial "orden de" abuso, pero esto no siempre es necesario. Algunas otras formas de evidencia son los siguientes: informes y declaraciones juradas de los agentes del orden, médicos, funcionarios de la escuela, el clero y los trabajadores sociales. El abuso puede ser físico o mental.
