Homeland Security Secretary Janet Napolitano has denounced Arizona Trespassing Law.

The major issue with the bill surpasses the trespass restriction. Which has wording that would make law enforcement to look at the immigration status of anyone that they stop. All these laws do is put the problem else, where other police departments in other communities have to set their own standards. Napolitano commented that is no fix and only makes a one dimensional resolution to law enforcement that does not fit other areas of the country. This bill is being pushed by Sen. Russell Pearce, R-Mesa, and Rep. David Gowan, R-Sierra Vista. There idea is to end what they call “sanctuary policies’’ in certain areas of the the state where law enforcement have been banned from checking peoples immigration status. The Secretary of Homeland Security also questions the legitimacy of the bill. One troubling aspect of the bill is having local law enforcement arresting anyone being an undocumented immigrant which is a federal immigration law and trying to use a state offense of trespassing. In the end, the courts may have to make a deterination on this matter, she commented.

El principal problema con el proyecto supera la restricción de la transgresión. Que tiene una redacción que haría la policía para ver el estatus migratorio de cualquier persona que se detienen. El Secretario de Seguridad Nacional también cuestiona la legitimidad de la ley. Un aspecto preocupante del proyecto es que la policía local detener a cualquier persona de ser un inmigrante indocumentado que es una ley federal de inmigración y trata de utilizar un delito de Estado de la violación. Al final, los tribunales pueden tener que hacer una deterination sobre este asunto, comentó.
