Victories

Brewer losses dismissal challenge in Arizona immigration case.

Well, another blow came to Arizona Governor Jan Brewer and the rest of her clan when a federal judge rejected her motions, and dashed her hopes of getting the lawsuit thrown out of federal court. The controversial Arizona immigration law which would make it illegal to be in the state of Arizon if you are an undocumented immigrant just got another nail in its coffin. United States District Judge Susan Bolton found that it is true that Governor Brewer is correct that the plaintiffs' allegations involve the possibility of future harm but the threat of future harm is sufficiently imminent. Also, that civil rights organizations have the right to bring a lawsuit forward because of the possible harm regardless of how the law is carried out. Ms. Bolton also pointed out that the 4th and 14th amendments could be violated, and that the Arizona law was written to discriminate against race, national origin and alienage. Judge Bolton also found that there were no provisions in the law to protect against any errors when trying to enforce the law because obtaining someone's legal status is not easy to obtain. Also, there is no outline of any crimes to throw a person out of the country and that this process should go through federal officials and not state or local agencies.
