Pearce wants to go after 14th Amendment.
Russell Pearce, the Arizona state senator who was the mastermind of the country's roughest law against undocumented immigrants said earlier this week that he and 13 other state lawmakers are trying to gain support from legislators to overturn the United States citizenship to the children of undocumented immigrants. Pearce believes that the 14th Amendment has been hijacked and needs fixed. He was unwilling to say how the law may be written and how it may be different from other attempts that have been put before a two-year congressional session since 2005. Needless to say not a one of these made it out of committee. We have written about how difficult it is to get the Constitution changed but here it is again. You need a 2/3 majority in both the House and Senate. The other way, which has never been done is 2/3 of state legislatures to ask for a constitutional convention. Then even if those are accomplished it still needs 3/4 of the states for ratification to become law. Not a very likely prospect with the country being equally diviided on this matter. Also, a professor at Arizona State University said that if they try to agrue on the grounds of subject to jurisdiction it will not do any good because the founding fathers only meant this for children born in the United States from foreign diplomats. Mr. Pearce is looking like a great candidate to be our first consecutive "Moron of the Month"! Stay tuned, there are just so many good candidates this midterm to call it yet.
