Troubles could be coming for Martinez's Driver License Policy.

One of the many problems with New Mexico Governor Susana Martinez's (R-NM), immigrant driver's license policy is that for starters it does not have a "foreign national" database. This is one of the reason the governor claims she wants to see if the system is getting abused. But the reason for the lack of correct information in the database is because during the the time frame of 2003 and 2008, American citizens were allowed to receive a New Mexico driver's licenses with other documentation other than a Social Security number. What that means is that a lot of drivers in New Mexico's "foreign" database might be as Red Blooded American as Susana Martinez herself. State Representative Brian Egolf (D-Santa Fe), even brought this point up the end of last year when he explained in a legislative committee session that he himself could be put on a foreign database because he used other documentation as identification when he received his driver's license. Another issue with the license round-up could be it is unconstitutional. People who got a New Mexico driver's license followed all the state rules and laws, paid for their license and have broken no laws as motorists. But now Martinez wants to try to go after people that have done nothing wrong just so she can check their residences status by ordering them to go to an Albuquerque MVD office. And if they do not comply they are threatened with having their license taken away. Lawyers for the Somos Un Pueblo Unido group are looking into the legality of Martinez's order to determine if they want to pursue a lawsuit.
