Victories

Arizona really did not win anything in it recent Supreme Court Ruling.

As I blogged about last week in regards to Arizona's recent "win" by the Supreme Court in respect to the states power to enforce business laws may not be such a win for them. The fact is that the Supreme Court did not really side with Arizona's argument but just put all the states on notice that the federal government is the supreme authority when it comes to the law on immigration enforcement. And the only reason Supreme Court upheld Arizona’s business enforcement law was because the federal government allows states to enforce licenses to businesses as an enforcement tool. Now on the topic that Arizona employers have to use E-Verify, the only reason it was upheld was because first off the federal government did not restrict states from enacting these measures and secondly the federal government determined that Arizona’s E-Verify mandate was “allowable.” So Arizona enjoy your recent "win" and you can thank the federal government for allowing it, because they have the supreme authority in all matters dealing with immigration law.
