This country's immigration laws as we know them are a concoction of 3 predominant enactments: the 1952 Immigration and Nationality Act (INA); the 1965 Immigration and Nationality Act Amendments (INAA); and the 1986 Immigration Reform and Control Act (IRCA). Albeit other immigration legislations has added in previous years, these above mentioned acts have demonstrated to be the foundation of the present day immigration laws.

| Hispanic voter Poll conducted. |

A number of leading Hispanic lawmakers from thirty-two states, paid for a poll to determine hispanic community envolvement. Over five hundred registered hispanic voters were polled in late January by way of phone interviews via English or Spanish. Frank Santos, a Texas lobbyist and consultant who asked for the poll, comment to the fact that it is a huge eye opener for both Democrats and Republicans. In one regard Hispanics are taken for granted by the Democratic's and the Republican Party shows no interest for Hispanic concerns. Around three million new people have increased the Texas population between 2000 and 2008. Sixty-three percent of theses classified themselves as conservative, but they are Democrats. And of those, seventy percent believe President Obama is doing a good job. What does this all mean? It means that the Hispanic voters are evolving and expanding the electorate.

In 1990 the foreign-born population of America was eight and half percent of the gross population. The distribution of immigrants in America during the time frame preceeding 1850 to 1940 was larger. This has never dropped below thriteen percent which includes the time period of 1860 to 1930. Now the distribution post the 1940's has been under this number. In comparison to the data from other countries 1990 distribution data it breaks down as follows: Australias distribution was almost twenty-three percent; Canada came in at sixteen percent; Germany was just under seven and half percent; France was just under six and a half percent; Great Britain was in at just under four percent and last but not least Sweden was at just over five and half percent.

| GOP wants to entice Hispanics at the polls. |

Because of the beatings the Republicans took in the 2006 and 2008 elections, they are scratching their heads and wondering how they lost so many of the Hispanic voters. With the GOP's long-established white-male base diminishing, party leaders are trying to win over the Hispanic voters with growing imperativeness about enticing them at the polls. Hispanics are the quickest-expanding sector of the American residents, and who tend to vote Democratic. Henry Bonilla, a former United States Representative has commented that the hope to win is impossible without the Hispanic voters support. The American Hispanic population is forecasted to grow by almost Two hundred percent by around 2050. While caucasins would consist of half of the countrys population, decreased from almost Seventy percent in 2000. In 1988 to 2008, the amount of Hispanic voters grew Twenty-one percent, from a little over Sixteen million to Nineteen and half million voters.

| The momentum is growing for Immigration Reform. |

The drive for comprehensive immigration reform is beginning to happen with some people in Colorado and combining with the rest of the country in uniting together is this important issue. United States Senator Michael Bennet was given a tongue lashing at one of four town hall meetings. Sen. Bennet talked at Manual High School in Denver last month at the biggest event. Nearly one thousand citizens showed up to demand Congress to fix America's broken immigration system. The speechmakers at the gathering addressed a current report that points out legalization would add one and half trillion dollars to the economy and produce almost five and half billion dollars in new tax revenues. Sen. Bennett is one of two senators whose support could help improve peoples lives.

| Republican legislation wants to limit who inherently becomes a U.S. citizen at birth. |

The United States Constitution can't get any more clear: Anyone that is born in America is a citizen, PERIOD. But when you start to add in undocumented immigrants into this formula it starts to make things a bit more problematic. Now many Anti-immigration activists believe that a crackdown on birthright citizenship is the answer. The argument being that too many undocumented immigrants come in to the country and then give birth to their children here. There is now legislation in the United States House of Representatives with Rep. Gary Miller, (R) as a co-sponsor. He believes people are flooding across the borders to have their childern here, which are citizen. Then the children go on welfare and other social services all on the taxpayers dime. The possibility of this legislation even entertaining a committee hearing are about a million to one. Rep. Joe Baca, (D) commented that the sponsors of this bill are just reviving up for an election year. These types of proposals only play on people's hatred and fears. This legislation does nothing to resolve the dysfunctional U.S. immigration system.

| More Troubles for Obama and Democrats. |

Yesterday, La Opinion which is one of the largest Spanish newspaper, ran an editorial regarding what is going on with comprehensive immigration reform or should I say what is not going on with it. The translated headline reads 'No more Empty Words." It blames the Obama administration and the Democrats in general for the lack of action on the issue of immigration reform in Congress. It points out that Democrats were able to accuse the Republicans for hampering comprehensive immigration reform, but that excuse does not hold water with a Democrat in the White House and holding advantages in both chambers. La Opinion is not the only one disgruntled on this important issue. The editorial goes on to say that there is a growing resentiment with hispanic voters. These voters turned out in droves in 2008 to give President Obama the White House and gave the Democrats the majority in both the House and Senate. These same voter came to the polls in large numbers to help Bush in 2004 to regain the White House.

Más problemas para Obama y los Demócratas Ayer, La Opinión, que es uno de los principales periódicos españoles, publicó un editorial sobre lo que está ocurriendo con la reforma integral de inmigración o debería decir lo que no está pasando con ella. El título traducido dice "No hay palabras vacías." Es culpa de la administración Obama y la Democrates en general por la falta de acción en el tema de la reforma migratoria en el Congreso. Señala que los demócratas han podido acusar a los republicanos por obstaculizar integral de inmigración reforma, pero esa excusa no se sostiene con un Demócrata en la Casa Blanca y la celebración de las ventajas de ambas cámaras. La Opinión no es el único descontento sobre esta importante cuestión. El editorial prosigue diciendo que hay una creciente resentiment con hispanos votantes. Los votantes acudieron en masa en 2008 para dar el presidente Obama la Casa Blanca y dio a los demócratas la mayoría en la Cámara y el Senado. | The Catholic Church continues it push for Comprehensive immigration reform. |

A drive called "Justice for Immigrants" is being orchestrated by the United States Conference of Catholic Bishops Committee on Migration. The churches are making postcards accessible to followers on Ash Wednesday, February 17, 2010 and on the following weekend of February 20-21, 2010. Then the Postcards are to be collected and sent to the Congressional delegation. Archbishop Vlazny sent out a memo to priests and in part, he mentioned that regardless of a person immigration status, either legal or undocumented, the fundentmental belief in our faith is based on the teaching of Christ who said to take care for aliens and newcomers. Comprehensive immigration reform is the correct path to ensure that this hardship is righted. The archbishop went on to say a lot of people are under the misconception that our undocumented brothers and sisters have come to this country unjustly. The facts are, they have showed up and for the majority of them, they are impoverished and disadvantaged brothers and sisters looking for a way to exist. The heads of the Church reminds everyone that the Holy Family were migrants. Speaking of immigrants, Pope Benedict has spoken about this and commented that everyone, man or woman should be regarded as brothers and sisters and are the children of the one and only Father. Many correspondences have been received that had concerns with the Church’s position regarding our undocumented sisters and brothers. They asked "Why should we care about people who break our laws?" We care because we believe in the enlightenment Jesus gave us through the words of St. Matthew’s Gospel in the 25th chapter, ‘For I was a stranger and you welcomed me.’ These are words we all need to live by.

| Over 12,000 Haitians apply for TPS so far. |

The number of Haitians that have applied for Temporary protected status (TPS) in hopes to stay in the United States and be able to hold a job leglly is now over 12,000 after their devasting earhtquake. The amount of people applying have been streaming in, well before the July 20 application deadline. Bill Wright a spokesperson the United States Citizenship and Immigration Services (USCIS) and is a department of the Homeland Security Department. The ability to work is all many have in hopes to be able to give some finanical support back to family memebers back in Haiti. Because of the magnitude-7 earthquake it is still not safe to send back the undocumented immigrants to Haiti. Temporary protected status has been granted by the DHS and if an applicant is forunate to stay in the country and work for 18 months without having to worry about being deported or being places in a detention center.

| AZ Sheriff collides with US government. |

A federal judge has determined that sanctions are warranted for an AZ sheriff's departmant. The department's involvement in the destroying of evidence in a lawsuit that alleges law enforcement officiers of racial profiling numerous Latino's. A United States District Judge Murray Snow did not hand down punishment immediately against the Sheriff's Department in Maricopa County and Sheriff Joe Arpaio last week. He did say he would at a later time once all the details to the issues were worked out. Since the beginning of 2008, Sheriff Arpaio has been involved with thirteen immigration and crimes raids that entailes deputies and posse volunteers who target a specfic area in a town which usually has a large hispanic population looking for people to stop for traffic violations. The small group of Hispanics who brought the lawsuit against the AZ sheriff's department alleged the stops were unwarrented. The only reason for the stops was so that the deputies could pull people over on the grounds of a traffic violation but the real reason was because Hispanics were in the vehicle. They had no legitimate reason to stop them and the only reason the stops were made was so the deputies could check to see if they were citizens or undocumented immigrants.

AZ Sheriff choca con el gobierno de EE.UU..
Un juez federal ha determinado que las sanciones están garantizados por departmant un sheriff de AZ. | Sheriff Arpaio on a collision course with U.S. government. |

Sheriff Joe Arpaio says he will disregard the government's undertaking to change his steadfast policy of federal immigration law. His action may be like an accident waiting to happen with the United States government. By the end of last year the United States Immigration and Customs Enforcement (USICS), the biggest agency of the Department of Homeland Security (DHS), took away Maricopa County Sheriff Joe Arpaio power to administer federal immigration law in his territory. The agency stepped in because Mr. Arpaio's zealous immigration clampdown drew a weary eye from human-rights groups that demand he had gotten out of control. The United States Justice Department, is looking into whether Mr. Arpaio had used racial profiling and exploited his power. The problem comes from the 287g a federal provision, that enrolls and educates police officers to recognize possible undocumented immigrant criminals in prisons and in public. This programs sole purpose was to go after dangerous criminals. Mr. Arpaio has been criticized for endorsing racial profiling and uses this provision as an excuse for his police officers to track down undocumented immigrants.

For the second straight year, the amount of undocumented immigrants residing in the United States has reduced, according to the Department of Homeland Security (DHS). In January of 2007, there were almost 12 million undocumented immigrants in the United States. In 2008, that number was reduced to just over 11.5 million. Then by January 2009, this number had dropped by 7%, down to just below 11 million, by all accounts of DHS. California, which has the greatest number of undocumented immigrants, is now at just over 2.5 million. DHS said that the reduced numbers came about with the economic slump in America, the Associated Press disclosed. Some authorities also believe stronger border enforcement for the decline.

Acknowledging appeals from immigration attorneys and judges who understand the U.S. immigration courts are failing under an enormous caseload, the American Bar Association (ABA) asked Congress to abandoned the existing system and make a useable, independent court for immigration cases. The attorney's association backs a proposal for an independent immigration court entity that would resemble the federal courts that determine tax cases. Immigration courts do not resemble other courts in the way Americans typically associate them. Immigration Courts are a branch of the Department of Justice (DOJ). They are not the federal judiciary, and these judges, even though they don robes and reside in courtrooms they are agents of the attorney general. While Congress has discussed a total revamp of the immigration system since 2006 which would include proposals to address legal status to millions of undocumented immigrants, solutions for repairing the court system has been greatly disregarded. A report back in 2008 discovered that Homeland Security agents detained over 378,000 immigrants and deported nearly 360,000. In a 2009 report it was determined with prosecutions staying at a comparable rate, a little over 230 immigration judges ruled over more than 300,000 cases, that works out to be more than 1,200 cases per judge, or around 3 times the caseload of federal district judges. Judges are simply stretched past their capacity and discouraged. Immigration cases are now more complicated, particularly asylum cases, where immigrants are seeking to stay in the U.S. because they allege fear of bodly harm up to death if they return to their native land. With the amount of cases growing, immigration judges remark that asylum hearings are like having capital offense cases held in small claims court. Attorneys and Judges have said that an independent court would have a lot more credibility and more power to find funding from Congress, making way for additional resources for judges, reduced times of detention for immigrants and less appeals to federal circuit courts, which are very expensive.

| How important will the immigration reform issue be for Hispanic voters in the Midterm elections? |

Advocacy organizations serving the interests of the Latino community predicted it will remain a critical test in the upcoming mid-term races. A communique that surfaced yesterday, from America's Voice summarized around forty mid-term contests where Latino citizens could have a large influence on the result. Frank Sharry, executive director of America's Voice, believes that the majority of members of Congress realize the significance of the Hispanic vote in election years. Also, Hispanic voters will have a critical effect in the mid-term elections. The amount of hispanic citizens coming into voting age and registering continues to rise. President Obama made a promise to the Hispanic community and and that promise needs to be remembered. National Council of La Raza President Janet Murguia commented that is a promise that the Latino community is going to hold him culpable for. In the same breath the Republicans can't remain on their current course to ignoring the immigration reform issue. The Latino community will undoubtedly keep all the politicians on the hook for this important topic.

A Texas immigration judge examines United States prosecutors for pursuing criminal charges against some undocumented immigrants. United States District Judge Sam Sparks said in a motion that he has concerns over the cost of prosecution of 3 Mexican nationals who were arraigned for illegal re-entry after being discovered in a Texas County Jail last week. He reported that the cost to incarcerate the 3 men has been over $13,000, for the federal illegal re-entry law. That does not even take into account any of the costs of prosecutors, defense lawyers, court personnel and others. All 3 of the Mexican nationals admitted thier guilt and were sentenced last week by Judge Sparks to time served and are in the process of deportation.

President Barack Obama’s aunt that is a native Kenyan finished her immigration inquiry recently without an instant decision on another try for asylum in America. Zeituni Onyango did not release a statement after giving testimony for over two hours in United States Immigration Court. Ms.Onyango said she is being retrained to use her legs again after being paralyzed from Guillain-Barré syndrome, an autoimmune disorder. The Judge Leonard Shapiro has not determined a timeline to make a ruling. The hearing could be resumed on May 25 if there is no resoution before the initial 30 days to submit a brief. It was thought that President Obama may have presented a letter to help assist her asylum case. Ms. Onyango attorney Margaret Wong commented that in no way had President Obama sent any letter. Also, Ms. Onyango said she has never asked for special treatment from her nephew or even disclosed to him her difficulties in getting asylum.

| Oklahoma immigration law loses battle. |

A few days ago a federal appeals court board upheld much of an injunction against Oklahoma's hard-nosed anti-illegal immigrant law. The state can now make contractors do audits on an employee versus a government list of eligible workers. In a divided a split decision from a three-judge board of the 10th United States Circuit Court of Appeals in Denver concluded that the United States Chamber of Commerce and a handful of other pro-commerce organizations had legal footing to dispute Oklahoma's immigration law. The law wanted to make accountable companies that hire undocumented immigrants with financial penalties, also they would have the final say who may or may not be fired and require contractors to hold back taxes for employees without proper documentation. The board said that the complainants would likely win with the majority of their claims. The state can still direct employers to a federal database of employees that qualify to work in this country. The lawsuit will now go back to the United States District Court in Oklahoma City so that a judge can decide whether a permanent injunction against the law should be declared. More to follow in the coming months.

An Army vet and a naturalized United States citizen who was held for almost eight months by immigration agents is suing the US government. Rennison Castillo is suing the United States Immigration and Customs Enforcement (ICE) and the officers who managed his case. This is a federal case (no pun intended) and it is progressing after a federal district court denied an argument by government attorneys to drop the case. The appeal by the government happened in December of last year. Mr. Castillo was born in Central America and became an American citizen after serving in the United States Army. Mr. Castillo asserts that ICE agents disregard his constitutional rights in 2005 by inadequately looking at their databases, which had the evidence they needed to show that he was indeed a United States citizen. Government officials alleges that the ICE agents were not willfully or intentionally trying to infringe on Mr. Castillo's constitutional rights.

A large number of Latinos are livid at President Obama State of the Union address last week for not making good on campaign promises to push for comprehensive immigration reform legislation (CIR). It is feared that Hispanics will stay away from voting in this year's midterm elections if real progress is not seen which includes legalization of undocumented immigrants, a top Democratic legislator said yesterday. U.S. Rep. Luis Gutierrez (D-Chicago) said that Obama’s inadequacy to move forward on immigration reform was exemplify by his State of the Union address last week, when he only talked for around 12 seconds about the (CIR) issue. Gutierrez said, that was the straw that broke the camel's back for the majority of activists who have been irritated by the old stagnet policies of deportations and other law enforcement actions, with no real continued reform legislation advancement. Gutierrez also said that this issue would be no small feat with unemployment hovering around 10%. But with no headway on this issue, the congressman predicts that a huge number of Latinos would not vote this year or in the 2012 presidential election. The exit polls showed that in 2008, Obama got a little over 60% of the Latino vote, propelling him to winning the White House in prior Republicans held states such as New Mexico, Colorado, Nevada and Florida.

Latino advocates said that President Obama basically forgot their faction in his state of the union address last week and that the mid-term elections could assist in being a mandate on his administration. Members at the initial National Latino Congreso addressed that President Obama hardly discussed immigration reform and appeared to have meager economic fixs for rampant unemployment and home foreclosures in the Latino community. The president of the WCVI, Antonio Gonzalez, said the upcoming midterm elections will be the venue for the Latino's to be heard. He also said that he thought 2010 would be a showdown year and that the Latino vote has enormous leverage. Immigration might be the key issue at the 4th annual Congreso this year. The participants will think about resolutions geared toward turning back foreclosure and unemployment rates and getting Latinos counted in the upcoming 2010 Census. The upcoming Census will be instrumental for the Latino community because Texas might acquire 3 to 4 positions in the United States House of Representatives.

Los participantes piensan acerca de las resoluciones dirigidas a retroceder las tasas de desempleo y de exclusión y conseguir los latinos cuentan en el próximo Censo de 2010. El próximo Censo será fundamental para la comunidad latina de Texas, porque podría adquirir 3 a 4 posiciones en la Cámara de Representantes de Estados Unidos.
