| Disappointing State of the Union regarding Immigration Reform. |

President Obama was elected last year with Hope and Change as his rallying cry. After over a year after taking office, not much has changed for most immigrant families in America. And the rhetoric of needing to fix the broken immigration system is beginning to get old with all talk and no action. In President Obama defense he was given a bad situation coming into office. With the economy in near meltdown, the growing deficit, unemployment around 10% and Comphresive Health Care Reform unresolved. Nonetheless, he still has failed to produce on his promise to the Latino community to fix the broken immigration system. President Obama's State of the Union speech last night reduced this issue to only 38 words, a mere 12 seconds on this topic, really 12 seconds on such an important issue? This really doesn't seem like the Hope and Change we elected him into office to accomplish.

Decepcionantes Estado de la Unión sobre la Reforma de Inmigración.El Presidente Obama fue elegido el año pasado con la esperanza y el cambio como su grito de guerra. The Catholic Charities of the United States was founded in 1910 on the Catholic University of America in Washington, DC. The National Conference was founded to advance the formation of diocesan Catholic Charities bureaus and to promote professional social work practice, to give a spirit of fellowship among those in charitable clergies and to be the advocate for the poor. Catholic Charities provide essential social aid to people in dire straits, regardless of their religious beliefs, social standing, or economic backgrounds. They also advocate for, and enable the underprivileged, downtrodden or susceptible and do this on a non-discriminatory basis. The recent disaster in Haiti is just another affirmation of the churches devotion to humanity in this time of crisis. We can all learn from their example in this matter.

Last Friday, 34 United States Senators, pushed for the State Department and Department of Homeland Security (DHS) to go the extra mile and permit children that had family members perish in the recent Haiti earthquakes and that have close family in the US to relocate here. This would be benetifial for a lot more children who, relief groups say, are now exisiting in temporary shelters, out in the open or with who ever will take them in. But these steps would not assist children who have a parent alive and living legally in America. Immigration experts say visa applications are handled on a case-by-case basis under policies set by Congress. They also say that if the State Department and Homeland Security do not engage in this effort in a timely manner, Congress should then move in. The children in Haiti have no time to spare.

Recent poll numbers show that over 80% of U.S. citizens think undocumented immigrants is a serious problem, and over 50% of voters say it should be a high importance for Congress to tackle. Over 65% of voters approves of comprehensive immigration reform (CIR) as a package, and over 80% think that unauthorized immigrants should register and work their way to become United States citizens. When polled if the country would be better served if unauthorized immigrants were made to go back to their home country to create jobs or for undocumented immigrants to remain and became legal citizens, close to 70% supported legalization and for them to pay taxes while only nearly 30% supportedfor them to leave the country to create jobs. For those paying attention, the real politics of immigration reform was showing during the recent Brown victory party. Mitt Romney was given a notable speaking role and spent a conciderable amount of time playing to the television audience. As you may recall in 2008, Mr. Romney was an zealous adversary of compehensive immigration reform (CIR). He believed he could use this matter to win support with extreme conservatives in the Republican party to defeat Sen. John McCain. Needless to say it failed miserably. In a 2009 interview, he now feels that one way to intice more Latino's to the Republican party is by pass CIR before the next election. It is also interesting that another possible Republican Presidental candiadte in 2012, Sarah Palin, also seems to be pro-immigration. Republican Meg Whitman who is in the California gubernatorial primary as pro-immigrant and pro-reform. The current poll numbers shows her leading the in the Republican race. It would appear that the GOP canidates with their sights on the future are starting to realize that they can not survive by losing the Latino voters. As a matter of fact, smart Republican insiders now understand that the only chance that a GOP Presidential nominee has to be competitive in 2012 is to regain the Latino-heavy states that Obama won from Bush--Florida, Nevada, New Mexico, and Colorado. To accomplish this, they have to win at least Forty percent of the Latino vote. In 2004, Bush won Forty to Forty-four percent of the Latino vote, and an estimated Forty-eight percent of the Latino immigrant vote. In comparison J ohn McCain in 2008 only won Thirty-one percent of the Latino vote, and only Twenty-five percent of the Latino immigrant vote.

| Pushing back Immigrantion Reform to 2011? |

I find it bizarre when anit-immigrant zealots proclaim that "We are not against immigrants coming to the United States, they just need to follow our laws." Obviously, they have never applied for permission to visit the US (travel visa), or God forbid, an employment-based visa (work visa). These people have no clue of the intricacy of the United States immigration system. You might as well put your feet over hot coals, you would probably have a much better experience. When Illinois Congressman Luis Gutierrez communicated the submittal of comprehensive immigration reform (CIR) last December, a great number celebrated. Rep. Gutierrez also reminded the current Administration, it's affirmation to introduce the issue in 2010. But with two ongoing wars, Health Care Reform still not passed and the economy in the tank I fear that CIR will be pushed back to the back burner once again. Rep. Henry Cuellar said recently that with the upcoming elections, and the need to complete the Health Care Bill and Jobs Bill it is not looking like CIR will not happen until 2011, how very disappointing.

A small group of workers, graduates and immigrant rights advocates assembled in Las Vegas to promote comprehensive immigration reform (CIR). The crowd that showed up last week initiated the inhabitants of Las Vegas Nevada to the national campaign on immigration reform. About Seventy-five people participated in the assembly outdoors in front of the Lloyd George U.S. Courthouse. The group encouraged legislators to fix the United States immigration laws such that it lets families remain united. The Head of Reform Immigration for American commented that the group wants a way for people to gain naturalization and unite families. Mr. Flores also said that he is disgruntled with legislators who are entrenched with problems like health care reform, saying immigration reform has been pushed to the side for far too long.

Advocates of comprehensive immigration reform united at Raleigh's Capitol Building in the downtown area earlier this week. The function, which was promoted by the Campaign to Reform Immigration for America spotlighted by speeches from a collection of ordinary citizens and faith leaders. This was a very good turn out for a great movement even in the shadows of the calamity in Haiti. We can only hope all Americans can hear this calling and get behind this essential movement.

| Protests against Sheriff Joe Arpaio |

A huge group of immigrant rights defenders advanced on a county jail in Phoenix this past weekend in a protest that was directed at Sheriff Joe Arpaio's immigration policies. Planners of the march wanted to convey they disapprove of Arpaio policies and it was designed to covey to people in Washington that he should not be in charge of immigration enforcement. Also, President Obama and Congress must find a way for immigrant workers to become legal in the United States. The demonstration which strung for numerous miles, began in a park concluded at the Jail facility. Officiers played music, and at one point played a Linda Ronstadt record, to muffle the chants by demonstrators. Ms. Ronstadt was on hand to show her support in Saturday's protest. Arpaio said he was unphased by the demonstrators and that they should take out their grievance with Congress because it has the abilitity to fix America's immigration laws. Almost a year ago, Arpaio discovered he was being investigated by the United States Justice Department for alleged prejudice and unlawful searches. He said the investigation was because of his immigration tactics and the feds have not given out any details. Arpaio's authority to arrest immigrants was taken away 3 months ago by officials in Washington, but he is undetered with his immigration tactics by way of 2 state laws. Also, a federal grand jury is looking into Arpaio and his department on allegations of abusing his authority.

President Obama affirmed he will allow undocumented Haitians that are currently in the United States to stay temporarily because of Haiti's devastating earthquake. Department of Homeland Security (DHS), Janet Napolitano authorized the Temporary Protected Status (TPS) on Friday, 2 days after she momentarily suspended deportations of Haitians, even if they are held in detention currently. This relief only applies to Haitians formerly in the United States from last Tuesday, and permits them to remain and work for eighteen months. Ms. Napolitano announced to the media that the TPS is a show of benevolence towards the Haitian people.
Temporary protected status is awarded to aliens who might not be able to reenter safely to their country because of a calamity, war or other circumstances. Haitians in the United States undocumented have begged for years for authorization to remain, work and send money to their families. This same practice was awarded to Central Americans in the late 90's after a hurricane ran sacked that area. Almost Thirty-thousand Haitians have directives to depart the United States the Department of Homeland Security estimates. A huge number of others are appealing their cases. The number of Haitians in the United States that are undocumented is around One hundred thousand to Two hundred thousand.

| Prositution ring busted in South Texas. |

In a South Texas home raid Federal agents arrested a bar owner and one of his bartenders after the raid found numerous Honduran girls apparently were coerced into hooking. Beleal Garcia Gonzalez and Elizabeth Mendez Vasquez are both undocumented Mexican immigrants and have been arraigned with harboring undocumented immigrants, immigration authorities said. A detention hearing has been scheduled for later this week and it is unknown if they are represented by lawyers. Immigration agents made a raid on the house in Mission last week. They found numerous undocumented immigrants which included three Honduran minor girls who's ages were from 14 and 17 years old. Court proceedings show they allegedly were made to work for Twenty dollars a day in Garcia's establishment, where they allegedly were blackmailed and prostituted to payoff their trafficking bill. The minors will be kept as material witnesses.

| Debate continues about economic impact of immigration reform. |

With the United States unemployment rate right around ten percent, the question remains about the immigration reform debate. Would giving millions of undocumented immigrants a path to citizenship worsen the economy or help it recover. This answer seem elusive because of the different spins people put on the most current reports. A survey published recently and endorsed by pro-immigration advocates said by adopting immigration reform would aid the economy in recovery. On the otherside of the isle a report sent out in December by a group that wants stricter immigration guidelines said less-educated United States workers will have a harder time to get jobs if undocumented workers become legalized. This argument could hold back immigration reform yet again if public opinion about undocumented immigrants is procieved as an impendence to laborers who are citizens or legal residents. We are not going to let that happen, say immigrant rights groups, because a majority of people agree with immigration reform. America's Voice, a pro-immigration group, published recent poll data on Monday revealing that even during a weak economy the preponderance of surveyed voters champion immigration reform. The data showed that fifty-five percent of eight hundreded polled voters agreed with the statement that the economic crisis "makes it more crucial than ever'' that Congress deal with immigration reform vs. forty-two percent who said this is not the right time for the issue. Even bishop John C. Webster of the Catholic Bishops committee piped up and said: "It's a red herring to say immigrants are going to take jobs.''

With the spotlight concentrated on putting the finishing touches on the debate over health-care legislation, Catholic bishops have indicated they will take part in ushering in the momentum for comprehensive immigration reform (CIR) this year. Dayton police officers are now banned from questioning the immigration standing of a witness or an innocent person of a crime by Chief Richard Biehl. He believes it will alleviate apprehensions some racial communities have with the police. Biehl announced an executive order to his almost 400 officers on December 30, advising them that the community must feel secure to call for police help without apprehension of unwarranted backlash. This decision is being applauded by Dayton Hispanic community, whose principals have commented that a lot of victims of crimes who can not produce papers of citizenship simply do not notify police of crimes because they are afraid of being arrested or even deported. Chief Biehl knows that informing police about criminal activity helps the entire community and everyone wants to stop crime in the city. Even though some people disagee with Chief Biehl's directive. Chief Biehl stands by his decision, which is patterned after endorsements from an association of police chiefs from the United States biggest cities. This absolutely helps police officers better serve the community and helps track down any terrorist element. The Dayton law enforcement will safeguard everyone in the community and by doing this all citizens, documented or undocumented, whether a victim or a witnesses to a crime can feel they can report it to the police. police. A handful of rural neighborhoods around the U.S. have violated the free speech rights of all by legislating prejudicial anti-solicitation laws targeting day laborers. The most recent town taking up this practice is Oyster Bay in New York's Nassau County. Oyster Bay has two consequential roadside hiring locations where day laborers assemble in the morning hours, aspiring to find work. In September, under the pretense of public safety, the town council sanctioned an ordinance totally prohibiting public job solicitation. The ordinance declares:
Examples of actions which designate solicitation of work includes but are not limited to swinging arms, making hand gestures, calling out to a person in a vehicle, jumping up and down, wielding signs asking for work directed at people in vehicles, advancing toward vehicles, standing in traffic while in the direction of vehicles in the street or moving into the street for the reason of getting a job. This implies that just the simple act of moving one’s hand back and forth is culpable under this law, a “violation” steming in a $250 fine! The First Amendment ensures the free speech rights of every person, not only United States citizens. By unjustly going after day laborers, who are usually Hispanic immigrants, this law infringes on everyone's constitutional rights to free speech and equal practice under the law.

Believe it or Not!

| Officials conceal truth on how immigrants died in detention centers. |

A spokeperson for the federal agency told the N.Y. Times that he could not find out anything about a case of a man that died of head injuries recieved in a N.J. immigration jail in 2007. Although, the records paint a different picture, this spokesperson had notified his superiors to the reporter's questions, and they had a lengthy discussion about returning the man back to Africa to prevent this shameful act in the public eye. Inquirers in the agency's Office of Professional Responsibility in yet another incident that year, determined that neglect and intolerable pain had been the main factor in the suicide of a 22-year-old detainee in the Bergen County Jail in N.J. Also, the medical center was so badly operated that other detainees were in jeopardy. After inspection of the jail medical staff they found that they had altered a log to give the impression that the detainee, a Salvadoran named Nery Romero, had recieved Motrin. The false entry was quickly detected because the drug was shown to be given after Mr. Romero was deceased.Incredibly those facts were never reported to the public or the the family of Mr. Romero, who by the way accussed the prison of holding back painkiller medicine to Mr. Romero. In February 2007, another incident of an African man near death in a detention center, Michael Gilhooly, the spokeperson for the immigration agency, dismissed a N.Y. Times reporter's inquiries about the detainee, who had recieved a head fracture at Elizabeth Detention Center in N.J. Gilhooly expressed that he needed a complete name and the alien's registration number or he would not be able to check on the case. Again, records revealed that he had previously placed a report tipping off upper management at the federal agency about the reporter's inquieries and giving information about the hurt man. A Guinean tailor named Boubacar Bah, had been abandoned in an isolation hold with no treatment for over thirteen hours before an ambulance was summoned. As Mr. Bah laid in a coma after emergency brain surgery, ten agency manager talked over via phone and e-mail about how to circumvent the expense of his treatment and the increasing surveillance and/or news publicity, that was in a memo outlining the discussion. One solution they looked into was returning the near death man back to his homeland, but a supervising deportation officer, wrote in an email that he did not approve of removal of Mr. Bah because of his current state of having a catheter and he was unconscious. Ultimately, in the light of coughing up around Ten-thousand a month for nursing home care, officials decided on a "humanitarian release" to cousins in N.Y. who insisted they had no means to provide for his treatment. Just days before that release, Mr. Bah passed away. In the agency's records was a jail tape revealing Mr. Bah face down in the medical center, handcuffed with his hands behind his back, rigth before the medical staff took him to a disciplinary hold. The video shows Mr. Bah screaming over and over in his native language, "Help, they are killing me!"

The head of Utah's Roman Catholic leadership, Bishop John Wester of Salt Lake City's diocese united with a N.Y. associate in the past few days, beginning a campaign in the United States encouraging Catholics to push for comprehensive immigration reform this year. Bishop Wester, believes that it is the most realistic and compassionate answer to the immigrantion problem facing the country adding it must get accomplished. Bishop Wester believes some of the signals that the administration and Congress are showing now are signs they are ready to take on this difficult issue. US citizens want a "humane and comprehensive" resolution to the dilemma plaguing the immigration system, Wester said. We need our government to concentrate on this issue and fix it now. The Catholic Church does not excuse illegal immigration, but believes in gods teachings and insists on standing by those pushed to the side in a broken system. Wester announced the bishops want five key reforms: a passageway for the twelve million undocumented immigrants in the U.S. to gain citizenship; fair handling of immigrant families; legal pathway for migrant workers; protection of immigrants due-process rights; and analysis of the real reasons for migration (usually poverty). Bishop Wester initiated a writing movement yesterday that already has taken orders for one and half million postcards from Catholic dioceses and parishes throughout the United States. Those will be mailed to Congress, advocating for immigration reform.

The United States Citizenship and Immigration Services (USCIS) has increased the filing cutoff for the expiration of the U Nonimmigrant Interim Relief Program. Everyone is now advised to file Form I-918, Petition for U Nonimmigrant Status, by 02/ 01/10. By filing this extension it will permit afflicted persons the possibility to file Form I-918 in a opportune time. USCIS issued an Update titled “U Nonimmigrant Interim Relief Recipients Reminded to Apply for U Visa - Temporary Benefits on 12/14/09. Then the USCIS issued an Update titled “U Nonimmigrant Interim Relief Recipients Reminded to Apply for U Visa - Temporary Benefits" Set to Expire 12/31/09. Then the USCIS issued an Update titled “U Nonimmigrant Interim Relief Recipients Reminded to Apply for U Visa - Temporary Benefits" Set to Expire 12/31/09. These announcements recommended applicants about the impending change and advised them to file Form I-918 before 12/31/09, to be able to stay eligible for U Nonimmigrant Interim Relief benefits. Even though new notices will not be sent to conceivably affected persons, this Update also changes the deadline in the mailed notice previously. | TSA new measures after failed bomb attempt. |

With the recent failed attempt to detonate a bomb on Northwest Airlines Flight 253 on Christmas day last year. That individual was stopped by the quick thinking of the passengers and the crew of that flight. Because of this incident the Transportation Security Administration (TSA) is working with airlines and law enforcement authorities, not to mention agencies with federal, state, local, and international agencies to close up gaps in security measures to ensure air travel remains strong. People going abroad domestically and internationally to the United States might see more screening measures. Americans should not cancel any travel plans. The TSA embolden everyone to keep a constant vigil and be aware of their surroundings and report any suspicious behavior or activity to law enforcement.

TSA nuevas medidas después del intento fallidos. Con el reciente intento fallido de detonar una bomba en el vuelo 253 de Northwest Airlines en el día de Navidad del año pasado. Ese individuo fue detenido por el pensamiento rápido de los pasajeros y la tripulación de ese vuelo. Debido a este incidente, la Transportation Security Administration (TSA) está trabajando con las compañías aéreas y las autoridades policiales, por no mencionar las agencias federales, estatales, locales y organismos internacionales para cerrar lagunas en las medidas de seguridad para garantizar el transporte aéreo sigue siendo fuerte. Las personas que van al extranjero a nivel nacional e internacional a los Estados Unidos podría ver más medidas de detección. Los estadounidenses no deben cancelar los planes de viaje. La TSA envalentonar a todo el mundo para mantener una vigilia constante y ser conscientes de su entorno y reportar cualquier comportamiento o actividad sospechosa a la policía.

| Recent Visa Bulletin for January 2010. |

The United States Department of State has announced the recent Visa Bulletin for January 2010. In the family-based classifications, there is a very negligible shift progressing ahead, by just a couple of weeks or months in the majority of classifications. The Employment-based classifications remain "Up to Date" for all first preference applicants, and for second preference from Mexico, Philippines, and countries with the exception of India and China. The Employment-based-2 for China advances ahead by one month, and Employment-based-2 for India stays the same from the previous month. The third preference classifications differed very little from the previous month. Employment-based-3 for China, Philippines and all other countries advanced ahead two months. Mexico moved ahead by one month and India by nearly two months.

El Departamento de Estado de Estados Unidos ha anunciado el reciente Boletín de Visa de enero de 2010. En la familia de clasificaciones basadas, hay un cambio muy insignificante progresa más rápido, por sólo un par de semanas o meses en la mayoría de las clasificaciones. El empleo basado en las clasificaciones de permanecer "al día" para todos los solicitantes de primera preferencia, y para la segunda preferencia de México, Filipinas, y los países con la excepción de la India y China. | Some Immigration programs extended to end of September 2012 |

United States Citizenship and Immigration Services (USCIS) affirmed just a while ago that some immigration programs will be prolongate at least until September 30, 2012. This after the signing of the Homeland Security (DHS) Appropriations Act of 2010 by President Obama on October 28, 2009. This entales the following programs:
Health Departments may still request waivers to the two year foreign residence requirements for J-1 nonimmigrant exchange visitors.
United States immigration will still accept applications under the "Conrad 30" program to let foreign medical graduates to adjust status to another visa category without the usual two year foreign residence requirement. Before, someone could only petition for this if the J-1 visa status had been accepted preceeding the September 30, 2009 deadline.
Department of Homeland Security (DHS) in along with the Social Security Administration (SSA) has jurisdiction of E-Verify. Currently there are over 167,000 employers using the program at nearly 650,000 work places in the United States to electronically determine the right to work by newly hired employees. From the begining of October 2009 to the end of November 2009 over 1.2 million employment verification examinations were made using the system. Nearly all of these examinations were routinely processed.
The immigrant investor pilot program the USCIS will still take into account applications regarding indirect job creation. This includes Forms I-526, Immigrant Petitions by Alien Entrepreneur, and Form I-485, Applications to Register Permanent Residence or Adjust Status.
Non-minister religious workers. This visa is for those within a religious vocation or occupation. It also encompasses their spouses and dependants. Applications on Form 1-360, Petition for Amerasian, Widow(er), or Special Immigrant and Form I-485, Application to Register Permanent Residence or Adjust Status, based on Form I-360 petitions will continue to be accepted.

We have realized much in 2009 - from coming together for family unity at the Capitol to over a thousand house parties for immigration reform across the United States to introducing the first major immigration reform bill after President Obama took office. Now, let's complete the work in 2010!
