Family-Based Green Cards

If you or a family member wants to become a legal permanent resident, keep their legal permanent resident status of the United States, or become a United States citizen, then there are several requirements that must be met. There are also varying steps that you and your relatives must follow as you seek immigration to the United States. Our qualified New Mexico immigration attorneys can work with you and your sponsoring relative to meet the legal requirements set forth by the United States Citizenship and Immigration Services (USCIS).

Requirements of Your Sponsor

When you are applying for a green card (also known as permanent residency visa or legal permanent resident alien status), you are requesting permission from the United States government to become a permanent immigrant with the United States as your primary residence. If you have a family member who is a permanent resident or U.S. citizen, then you may be able to apply for a green card. The family member who is your sponsor must meet the following requirements:

  • Be a legal green card holder or U.S. citizen
  • Have a qualifying family relationship with you
  • File a petition to sponsor you
  • Supply proof that they can support you above the poverty line

Family-Based Green Card Information

There are different restrictions regarding who you or your relative can sponsor, depending on whether he or she is a permanent resident of the U.S. or a U.S. citizen. Legal citizens of the United States have more leeway as far as which relatives they are allowed to sponsor. A U.S. citizen can petition for various family members including a spouse, children, parents, and siblings. A green card holder can legally petition for a spouse or unmarried child. There are varying rules and regulations regarding age and marital status of the family members that you may want to sponsor. Our trained and experienced New Mexico immigration lawyers can discuss your options and help you determine whether your family member can be legally sponsored by you.
