Q: Can you explain how a "priority date" is determined?

A: This answer depends on the type of immigration case you have.  There is a difference between family-based and employment- based petitions.

1. 
Priority dates regarding family-based petitions are determined by the date that the petition was filed.
2. 
Priority dates regarding employment-based petitions are determined by the date that the labor certification was filed with the Department of Labor. You can look at the priority dates on our website or go to the Visa Services homepage.

Q: How do I go about making my relative a legal permanent resident or green card holder?

A: Well, first and foremost becoming a legal permanent resident means that the person is being admitted as an immigrant. There are two main ways for someone to receive an immigrant visa:
1. An alien can get one through a family relationship with a United States citizen or legal permanent resident.
2. Or an alien can get it through his or her employment.

Q: Does anything need to be done to get a fiance(e) visa switched to an alien registration (green card)? 

A: Yes. The couple has 90 days after the fiance(e) enters the US to marry.  Once the couple is married, the United States citizen is required to contact Citizenship and Immigration Services to get the now alien spouse's status changed to legal permanent resident. This should be explained to the alien fiance(e) before their coming into the United States.

Q: How do I go about enrolling in the visa or green card lottery?

A: There is only a limited time period each year to submit an application for the lottery.  The procedure for applying can change yearly so it is best to review the procedure before submitting an application.  You can either check with us or look at the Department of State's website once the lottery is announced.
