The Priority date is assigned to a petition and that is the date that the petition is received by the appropriate government agency. There are a set number of visas or green cards issued every year for these two groups. The United States Citizenship and Immigration Service (USCIS) puts the person in a category once the petition has been received and until a person's priority date is reached. Once this happens, usually there is nothing else that can be done for the intending immigrant. Also every month the Department of State determines the amount of visas in each group that have been used and determines accordingly how to readjust the priority dates that will be current for the following month. It is very possible that for any given month some priority dates will move forward while other months these dates will go backwards. Needless to say, the dates can remain the same or simply become unavailable. Because of the extreme importance of the priority date, it is absolutely necessary that you know your visa category, your priority date and what date is current and will be current for the upcoming month. So you may ask, now that I know what a Priority date is, what does it have to do with me and my immigration case? Well in its basic form of immigration law it is the date where a petition for immigration or a labor certification has been originally filed. The priority date is used by United States Citizenship and Immigration Service (USCIS) to capture where the the designated immigrant's spot is on the waiting list for a green card. There are waiting lists for any green cards which require an annual restricted amount of petitions. Every month, the United States Department of State compiles a "Visa Bulletin" which has a current list of priority dates. This just means that any person with a date that coincides or is before the dates on the list is now eligible and can move forward with their application for a green card.
