A priority date as it applies to immigration law is the designated date when a petition for immigration or a labor certification was first received by either U.S. Citizenship and Immigration Services or the Department of Labor. This "priority" date is then adopted and used as a marker for the endeavoring immigrant's spot in the green card waiting list. It should be noted that these lists are used in virtually every green card category that has a set number of green cards available per fiscal year. The United States Department of State produces a new "Visa Bulletin" every month with an amended list of priority dates. What this means is that anyone whose date is the same or before the date on the list for their category can finally end their long wait and proceed with the process of getting a green card. Now in regards to family based immigration law, the law separates potential family based immigrants into two groups: immediate relatives and preference groups. Immediate relatives are exactly what the names implies: the parents of a United States citizen over the age of 21, a wife or husband of a United States citizen and lastly a child of a US citizen if the child is they are under 21 year old of age and single. Priority dates are not assigned to Immediate relatives because there is always a visa available for immediate relatives. Preference groups are other family members of United States citizen's and legal permanent residents. For US citizens the family members are: Brothers and sisters, an unmarried son or daughter that is over 21 and the married son or daughter of a United States citizen and possibly the spouse of the son or daughter. The other Preference groups are for family members of legal permanent residents. They are: are the spouse of a legal permanent resident and the unmarried child of a legal permanent resident no matter what the of age of the child as long as they have not married. Preference groups are subject to and are controlled by priority dates.
